Last year when we passed the Racial Justice Act, we vowed to come back to make the bill retroactive. We are excited to honor Dr. King’s legacy today with RJA4All to extend equal justice under the law for ALL Black & Brown people impacted by racism in the courts. Passing the Racial Justice Act in 2020 was a HUGE step forward, but our work is not done.
How can you Support the Racial Justice Act for All, AB 256?
BACKGROUND
The California Racial Justice Act of 2020 allows a defendant to file a motion at trial or following conviction challenging racial discrimination in their case based on one of five criteria. If the defendant proves the discrimination occurred, then the case will be sent back for a new trial, or the judge can adjust the charges or sentence in the interest of justice. Our goal in passing AB 256 is to make the Racial Justice Act applicable to people who have already been convicted in cases where racism was a factor.
